These terms and conditions (“Terms”) set out in this agreement between The Great Outdoor Gym Company Activate Ltd (“TGO activate, Us”, “We”, “Our”) and You when You register with Us on TGO-activate.com and/or use Our outdoor gym facilities.
There may be additional terms and rules which apply to a particular outdoor gym facility and You should familiarize yourself with these. You are advised to read these Terms and rules carefully. By continuing with Your registration on Tgo-activate.com and whenever You use Our website or Our outdoor gym facilities, You confirm that You understand and accept all of the Terms below and you will adhere to any local rules too.
1. Classes and courses
1. Your class or course is non-transferable. You must not allow anyone else to use class or course
1. Classes and courses can be done at TGO gyms or at home. You must adhere to local rules on the gym and adhere to any current government guidelines in place at the time. You must ensure you have space to do your exercises safely.
1. We will ask you to feedback at the end of each course so that we can show you your progress and so we can understand if you like our content. We will use this data to improve the courses.
2. Fees and payment
2.1 Payment is made via the website www.tgo-activate.com .
2.2 We will not store your bank details.
2.3 All Fees are paid in advance
2.4 All Fees are paid non refundable
2.5 Payment will be taken via a valid Credit Card/Debit Card.
3. Communication and Data protection
3.1. We are committed to respecting Your privacy. For the purpose of the Data Protection Act 1998 (the Act), TGO activate is the data controller of your personal data At the expiry or termination of Our service contract, TGO’s Partner Organisation (where there is one) will become the Data Controller and TGO will become the Data Processor
3.2. We have collected Your data for i) providing classes and courses services to You, ii) the management and administration of Your Registration, or iii) to evaluate the uptake of our courses and classes. iV) to communicate to you about your class or course or other courses you might like.
3.3. You acknowledge and agree that Your personal data may be processed by and on behalf of Us by partner organisations and/or shared for the purposes stated in 3.2 with
3.3.1. Partner Organisations
3.3.2. Any company which we control or which controls Us (‘control’ means the ability to direct the affairs of that other company, whether by ownership of shares or otherwise); and
3.3.3. Any Partner organisations such as our web developers or other who need the data to make the function work for the purpose of enhancing your experience on TGO-activate.com
3.4. Subject to clauses 3.5 and 3.6 below, We will not share your personal data with any other third party unless permitted to under the Act, including but not limited to disclosures i) required for the prevention or detection of crime, or for the assessment or collection of tax or duty, ii) required by law or by order of a court, iv) for the purpose of, or in connection with, any legal proceedings
3.5. Where We are providing services on behalf of a Partner Organization You understand that at the end of Our service contract when the Partner Organization becomes the Data Controller, We will comply with their instructions in respect of Your data, which may include instruction to destroy the data, return the data to the Partner Organization/Client or pass the data to a new processor (the new service provider). We will make reasonable efforts to inform you of our instructions at the appropriate time

5. Intellectual Property
You acknowledge and agree that all intellectual property on www.tgo-activate.com or associated emails and newsletters including video, logos, words and imagery are the property of The Great Outdoor Gym Company Activate Ltd and must not be copied, shared or used without permission unless it is on social media for promotional purposes, in which case we would like to be tagged in the post.
6. Responsibilities and health and safety
6. You will be required to complete a PARQ (Physical Activity Readiness Questionnaire) before taking part in any class. If you repeat your class or course you shall ensure the PARQ is repeated to ensure you are still in good health to take the course. Your health is your responsibility. Exercise carries its own risk, and you should therefore never exercise beyond your ability. If you have any doubts as to your fitness or you have any medical condition that may affect your safety through exercise, you should seek advice from your doctor, GP or other medical practitioner before partaking in the activity. Any advice given by our activators and trainers is given in good faith and should not be relied on if You have health conditions
6. You are not permitted to partake in classes and courses when under the influence of alcohol or illegal drugs

6. You confirm you take full responsibility for your health and safety whilst taking this course
7. Tree planting and charity
7. Our tree planting scheme is currently with Eden Reforestation Project in Kenya. We reserve the right to change tree planting providers if we need to.
7. We will ensure that the trees associated with the classes and courses you have purchased will be funded by TGO in batches as requested by our tree planting provider. We will log the total tree count for your trees on your dashboard and the total tree count on the homepage which will be updated periodically.
7. The charitable donations will also be grouped into quarterly donations or at intervals that suits the beneficiary charity
8. Health research and data
8. We reserve the right to use the data on your activity, feedback and progress in anonymised format to publish statistics, feedback and results to communicate the benefits of the classes and courses.
9. How We Contact You
The large majority of our outgoing communication, to the TGO Activate community, is via email. Sending an email to you is a form of data processing, and as such may only be carried out under a specific lawful basis.
9.1 Under the Lawful Basis of Fulfilling a Contract
In order to fulfil our obligation to you as a registrant of TGO activate, there are some communications we send to everyone. The following communications fall into this category:
- Confirmation you have registered with us.
- Updates to key documents, such as this privacy policy.
- Updates about your course or other courses
- Participation in surveys to improve the events we deliver.
9.2. Under the Lawful Basis of Legitimate Interest
There are some occasions where we may contact you as part of our mission to make the world healthier and happier. For example, where we write to people who’ve registered but not participated, with the aim of understanding why and then being able to create a more supportive environment. The following types of communications fall into this category:
- Questionnaires aimed at developing our understanding of who is participating.
- Emails sign-posting participants to peer-support groups we feel may be suitable based on information you have provided.
- Questionnaires for research aimed at understanding the effect of TGO Activate on global health and wellbeing.
- Local event teams directly contacting specific TGO Activate registrant using e-mail

10. Raise a concern
If, at any time, you have a concern as to how we are handling your information then please e-mail [email protected]. If you feel that we have not addressed your concerns appropriately you have the right to raise them directly with the ICO (read more).
